Terms of sale

Seller

Medina Diamonds VOF, Philemon Haumanstraat 21, 9140 Temse, Belgium, VAT BE1037.080.943, registered diamond trader with the FPS Economy under number 11727.

Scope

These terms apply to all sales by Medina Diamonds VOF. We sell exclusively to registered businesses in the jewellery and diamond trade. Sales to consumers are excluded. Any terms of the customer do not apply unless accepted by us in writing.

Products

Laboratory-grown diamonds are always identified as "laboratory-grown" on the website, order confirmation and invoice. Natural diamonds are sold under the System of Warranties. All certified stones are sold with their original grading report (IGI or GIA).

Prices

All prices are in EUR, excluding VAT, and subject to prior sale. If a stone is no longer available after an order is placed, we will inform the customer and fully refund any payment made. No other compensation is due.

Orders and payment

An order is binding once confirmed by email. After placing an order, the customer receives a pro forma invoice. Payment is made by bank transfer before shipment, using the order number as reference. Stones in an unpaid order are reserved for the customer. Medina Diamonds may cancel unpaid orders at any time. The final invoice is issued after receipt of payment. Cash payments are not accepted.

Retention of title

The goods remain the property of Medina Diamonds VOF until full payment of the invoice.

Shipping and risk

All shipments are fully insured by Medina Diamonds for their invoice value until delivery to the customer. Risk passes to the customer upon delivery. The customer must inspect the parcel upon receipt. Parcels showing visible damage or tampering must be refused or accepted under reserve with the carrier.

Complaints

Damage, missing items or an incorrect order (wrong stone, wrong weight, wrong quantity) must be reported in writing within 48 hours of delivery, with photos of the packaging and the goods. Complaints regarding conformity with the grading report (e.g. weight, color, clarity, laser inscription, natural or lab-grown origin) must be reported in writing within 7 days of delivery. After these periods, the goods are deemed accepted.

Returns

All sales are final. Returns are only accepted for goods damaged during transport or for an incorrect order as described above, after a complaint within the stated periods and with our prior written approval. The goods must be returned unset, unaltered, in their original condition and with the original grading report. Stones that have been set, re-cut, treated or are returned without their original report are not accepted. For approved returns, we cover the return shipping and, at our choice, replace the goods or refund the purchase price. No returns for change of mind.

Liability

Our liability is limited to the invoice value of the goods concerned. We are not liable for indirect or consequential damages, including loss of profit, loss of customers or reputational damage. This limitation does not apply in case of fraud or intentional misconduct.

Customer identification

As a diamond trader registered with the FPS Economy under number 11727, we are required by Belgian anti-money laundering law to identify every customer, its representatives and ultimate beneficial owners. Customers must complete identification before their first order can be processed. We may refuse or suspend accounts and orders if identification is incomplete or raises concerns.

Governing law and jurisdiction

These terms and all sales are governed by Belgian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Any dispute falls under the exclusive jurisdiction of the courts of Antwerp, Belgium.
